1 General provisions

The e-commerce website of YKON interiors offers customers the opportunity to purchase products from its store online.

These Terms and Conditions apply to every order placed by a visitor to this e-commerce website or by e-mail in contact with YKON interiors (hereinafter ‘customer’). When placing an order via the YKON interiors online store, the customer must expressly accept these conditions, thereby agreeing to the applicability of these Conditions, to the exclusion of all other conditions. When placing an order for a custom-made rug or cushion, please refer to the conditions in the confirmation of the order. By making the down payment the customer agrees to this. Additional terms and conditions of the Customer are excluded, unless they have been accepted in advance, in writing and expressly by YKON interiors.

2 Price

All prices stated are expressed in Euro, always including VAT and all other duties or taxes required to be paid by the Customer.

If delivery, reservation or administrative costs are charged, this will be stated separately. If you order outside Europe, you must take into account any customs clearance costs, import duties and taxes charged by customs as additional costs.

The price statement applies exclusively to the items as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

3 Offer

Despite the fact that this website has been compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the offer do not bind YKON interiors. YKON interiors is only bound by an obligation of means with regard to the accuracy and completeness of the information provided. YKON interiors is under no circumstances liable in the event of manifest material errors, typesetting or printing errors.

If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request the Customer to contact us in advance.

The offer is valid while stocks last and can be adjusted or withdrawn at any time by YKON interiors. YKON interiors cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be expressly stated in the offer.

4 Online purchases

The Customer purchases a product via the YKON interiors website by adding products to the shopping cart. The Customer makes the payment by clicking on the ‘Checkout’ button and entering his invoice and payment details. The Customer places the order by clicking on the ‘Place order’ button.

After the Customer has placed the order, the Customer will receive a confirmation. As soon as payment has been received and the order is ready for shipment, the Customer will receive an email with a Track & Trace number.

Custom made orders
In the event that a rug or other custom product is ordered, the Customer will receive an order confirmation via e-mail containing all product details. The Customer confirms the order by paying 50% deposit. The customer also undertakes to pay the remaining 50% upon receipt of the product in Belgium and just before shipment to the customer.

Because YKON interiors products are completely handmade, it is possible that the final product may differ slightly from the design. YKON interiors maintains a margin of maximum 4% deviation on the dimensions. A small deviation in the pattern is also possible.

YKON interior is entitled to refuse an order due to a serious shortcoming on the part of the Customer with regard to orders in which the Customer is involved.

5 Delivery and execution of the agreement

Items ordered via this online store are delivered internationally. Delivery is made by bpost, DPD or post NL via MyParcel. The delivery times are 1 day for Belgium, 2 days for the Netherlands, 1 week for other countries within Europe and 2 weeks outside Europe. Shipping costs will be borne by the Customer for orders of less than 300 euros and will be indicated to the Customer before payment is made. You will receive your order at the specified address.

Customized items or pre-orders have a different delivery time, as indicated in the product information. This concerns 3-4 weeks for a cushion and 10-12 weeks for a carpet.

Any visible damage and/or qualitative shortcoming of an item or other shortcoming during delivery must be reported by the Customer to YKON interiors without delay.

The risk of loss or damage passes to the Customer once he (or a third party designated by him, who is not the carrier) has acquired physical possession of the goods. However, the risk is already transferred to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by YKON interiors.

6 Retention of title

The delivered items remain the exclusive property of YKON interiors until full payment has been made by the Customer. If necessary, the Customer undertakes to inform third parties of YKON interiors’ retention of title, for example to anyone who would seize items that have not yet been fully paid for.

7 Right of withdrawal (returns)

The provisions of this article only apply to Customers who purchase items online from YKON interiors in their capacity as consumers.

The right of withdrawal applies to products purchased from YKON interiors that are in stock (immediate delivery). The right of withdrawal does not apply to custom made orders. The Customer cannot exercise the right of withdrawal for the delivery of goods manufactured according to the Customer’s specifications, such as custom made rugs or cushions.

If the right of withdrawal applies:

  • The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving reasons.
  • The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the good.
  • To exercise the right of withdrawal, the Customer must inform YKON interiors, hello@ykoninteriors.com by an unambiguous statement of his decision to terminate the agreement.
  • To comply with the withdrawal period, the Customer must send his communication regarding his exercise of the right of withdrawal before the withdrawal period has expired.
  • The Customer must return or hand over the goods to YKON interiors, Stokerijstraat 84G, 2110 Antwerp as soon as possible, in any case no later than 14 calendar days after the day on which he communicated his decision to withdraw from the agreement to YKON interiors. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods will be borne by the Customer.

If the returned product has been reduced in value in any way, YKON interiors reserves the right to hold the Customer liable and claim compensation for any reduction in value of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to determine the nature, characteristics and functioning of the goods.

Only items that are in the original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned.

If the Customer revokes the agreement, YKON interiors will refund all payments received from the Customer up to that time, including standard delivery costs, to the Customer within a maximum of 14 calendar days after YKON interiors has been informed of the Customer’s decision to cancel the agreement. to revoke the agreement. In the case of sales agreements, YKON interiors may withhold reimbursement until it has received all the goods back, or until the Customer has demonstrated that he has returned the goods, whichever comes first.

YKON interiors will reimburse the Customer with the same payment method with which the Customer performed the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged any

8 Guarantee

Under the Act of 21 September 2004 on the protection of consumers in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

If a defect is discovered, the Customer must inform YKON interiors as soon as possible. In any case, any defect must be reported by the Customer within 2 months of its discovery. Afterwards, any right to repair or replacement expires.

The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the item contrary to the purpose for which it was designed, failure to comply with the user instructions or manual, adjustments or changes to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase and, if applicable, delivery, are deemed not to be hidden defects, unless the Customer proves otherwise.

10 Sanctions for non-payment

Without prejudice to the exercise of other rights that YKON interiors has, in the event of non-payment or late payment, the Customer owes interest of 10% per year on the unpaid amount by operation of law and without notice. In addition, the Customer is legally liable and without notice to pay a lump sum compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, YKON interiors reserves the right to take back items that have not been (fully) paid for.

11 Affect of validity – non-renunciation

If any provision of these Terms is declared invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.

Failure at any time by YKON interiors to enforce any of the rights listed in these Terms and Conditions, or to exercise any right thereof, will never be considered a waiver of such provision and will never affect the validity of these rights.

12 Changes to conditions

These Terms and Conditions are supplemented by other terms and conditions that are explicitly referred to and the general terms and conditions of sale of YKON interiors. In the event of any contradiction, these Terms and Conditions shall prevail.

13 Evidence

The Customer accepts that electronic communications and backups can serve as evidence.

14 Applicable law – Disputes

Belgian law applies, with the exception of the provisions of private international law regarding applicable law.

The courts of the Customer’s place of residence have jurisdiction in legal disputes. The Customer can also turn to the ODR platform.
